MURDER CHARGE DISMISSED.

HEARING AT AUCKLAND. Per Press Association. AUCKLAND, April 19.. At the conclusion of the evidence in the case of Christopher Charles Brown aged 22, a fish curer, who was charged in the Police Court with the murder and, alternatively, with the manslaughter of Stephen "Walter Garter, on March 31, the charge o( murder was dismissed for want of prosecution. Counsel submitted that a prima facie case had not been made out in the case of manslaughter and the affair seemed almost pure misadventure. The Magistrate considered the police had made out .a prima facie case. The evidence was that the men were fighting in a public place and it seemed accused knocked deceased doyn and death ensued as a result of the fall. Accused pleaded not guilty to the charge of manslaughter and was committed to the Supreme Court for trial. Bail in one surety of £SOO was allowed.
