QUESTIONS ANSWERED BY „ ' COURT. The Conciliation Commissioner for the Northern Industrial District recently submitted questions for determination by the Arbitration Court regarding the establishment of local awards, and the effect of disagreements in Conciliation Council on tho local operation of Dominion awards. The first question was as follows: — “Can a local association of employers who are parties to an existing Dominion award cite a local union for the purpose of obtaining a local award or agreement, while such .union of workers remains a member of the federation of workers who are also a party to the same award as the Auckland employers?” The .Arbitration Court has delivered judgment giving the answer in the affirmative, and adding the following: “If it is desired to join the federation as a pnrtv to the dispute, any party may apply for its joinder, but failure to do so does not affect the validity of the proceedings.” Tho second question was: —“In the event of no agreement being arrived nt during the Council of Conciliation proceedings, and the Commissioner having notified the Clerk of Awards to that effect, would such notification result in the cancellation of the Dominion award so far as the Northern Industrial District is concerned?” The Court has also answered this query in the affirmative with the following qualification :—“lt should be noted, however, that, if all employers and unions that ought to bo cited are not cited, the Commissioner should require either (1) a reduction in the area affected by the dispute, or (2) the joinder as parties of all employers and unions of workers in the industry in the area affected.”
