TRANSPORT APPEAL CASE.
DECISION RESERVED. Per Press Association. AUCKLAND, Oct. 11. Mr Justice Smith to-day heard the appeal of the Auckland Transport Board against the decision of Mr F. K. Hunt, S.M., in the case in which three taxi drivers were prosecuted for plying for hire without a certificate of fitness under the Transport Licensing Act. The drivers, on race day, carried passengers from the Epsom racecourse. The fares were assessed separately, but the total amount was collected from one passenger. Mr Hunt ruled that no offence had been committed. Counsel for the board argued that taxi drivers were not permitted .to charge separate fares without being Counsel for the drivers contended that taxis were excluded from the Act no matter on what system the fare’s were charged. . His honour reserved decision.
