In summing up. a. claim for damages In the Supremo Court at Auckland, Mr Justice Smith said that a passenger in a motor car had no control ovor the driver, and, even if it ■were proved that the person in charge of the car in which tlio passenger was riding was negligent; a passenger could, in the event of an accident, claim damages against the driver of the other car. A passenger could also claim damages against the drivor of the car in which he or she was riding, and for this reason many motorists now declined to give “lifts” to pedestrians they overtook on tlio roads.
