PAHIATUA.

(From Our Own Correspondent.) PAHIATUA, Aug. 14. Mr J. Miller, S.M., presided over the usual monthly sitting of tho Magistrate's Court to-day. Walter Douglas Burgess, a farmer, of Mangamaire, 50 years of age, was charged that while in a state of intoxication, he was in charge of a motor car; that he drove the motor after being forbidden to do so by a police constable and that ho used obscene language in a public place. Mr G. Harold Smith appeared for defendant, who pleaded guilty to the three charges. Constable F. Burrell stated that on the date in question accused was in town, and, owing to his state was forbidden by Constable Gainey to drive his motor-car. Later ho drove off in the car and was found by the police at Mangatainoka in his car in an intoxicated condition. When arrested, he struggled and fought and used the language complained of. Mr Smith, stated that this was accused’s first offence of this nature. He was struggling to make a living as a small dairy farmer. He only came to town occasionally, and on the date in question had more liquor than ho should have had. The car was essential to him on account of his occupation and he had no one at home who could drive for him. Tho defendant was prepared to take out a prohibition order. The Magistrate stated that he had the public to consider in the matter and it appeared to be a bad case. On tho charge of driving a motor car while in a state of intoxication defendant was convicted and fined £2O, costs 11s, and in addition his driver's license was' cancelled for six months. On application bc-ing made he was allowed to pay this amount at the rate of £5 per month. On the second charge, of driving a car after being forbidden to do so, ho was convicted and fined £2, with costs 3s. and for using obscene languago ho was convicted and fined £2, in default 14 days' imprisonment. Lewis Reeve Turfrey, who did not appear, was charged with faffing to give wav to traffic approaching from hfs right. A fine of £3 with court costs 10s was imposed. The county ranger proceeded against John O’Neil for allowing sheep to be at large on a public road. Defendant was convicted and fined ss, court costs 12s and solicitor’s fee 10s 6a. The traffic inspector of tho Bahiatua County proceeded against several motorists for failing to have a motor drivers license. They were fined as follow:—A. Dohertv £l, costs £1 5s 6d; Oswald Lashford (who appeared) 10s, casts £1 5s 6d; Norman Shelton £l, costs £1 5s 6d. The Native Trustee was also summoned for permitting a lorry to carry more than the maximum load it was licensed to carry. An explanation was offered and a fine ot £3 with costs £1 5s 6d was imposed. Judgment for plaintiffs by default in the following debt cases was entered:—Wellington Creameries Employees’ Union v. L. J. Smith £1 ss, costs 16s; L. T. Russell v. A. H. Eager 7s lOd, costs 12s; Wellington Creameries Employees’ Union v. T. Rzoska, £1 ss, costs 10s; E. C. Cavanagh v. \\. J Baird £5. costs £1 3s 6d; \\. A. Cittadin v. F. H. Morris £1 11s 6d, costs 12s.
