FAILURE TO PAY.
DEFAULT IN MAINTENANCE.
Charged with defaulting in the payment of maintenance at the rate of £1 per week for his wife. Hannah Mary Lucretia McGarvey, without reasonable cause, Arthur McGarvey appeared before Mr J. L. Stout, S.M., in the Magistrate’s Court to-day. “I quite admit owing it, as I have not been in a position to pay, having been employed only casually,” said defendant. His Worship: Untd the order was made you had no difficulty in obtaining the work and making payments. Defendant: Yes, and then my work was dulv taken from me. His Worship: I am referring to the time since the order was made. Defendant: On my return after that order my job was closed with the Public Works Department, by which I had been employed for two years. It i& not a matter that I will not pay, but I cannot. You have to clothe and feed yourself to work. . His Worship: You are £l6 in arrears now. , ~ . . , ,! My tools and bicycle have been sold during my absence,” declared His Worship: I don’t consider that vou have done your best under the circumstances. You have no business to he £l6 in arrears now, Do you expect your wife to keep herself on n °MoGarvey was convicted and sentenced to 'one month’s imprisonment with hard labour, the warrant to be suspended as long as he pays ciirient maintenance and 6s per week off the arrears.
