ENGLISH FIRM’S APPEAL. SYDNEY, March 30. The Full Court allowed the appeal of Babcock and Wilcox, Limited, against the Magistrate’s decision, convicting and fining the firm £IOOO, and ordering them to refund £IO,OOO to the City Council, for an alleged offence under "the Secret Commissions Prohibition Act. The majority of the court held that while there might he a suspicion, suspicion could never be accepted as ground for conviction, which should rest only upon established fact. The charge against the firm arose out of the case in which S. Y. Maling was charged with graft over the Bunnerong power house contract. . Maling, deputy-manager of the Electricity Department, was sentenced to a term of imprisonment for his share in the proceedings.'
