The chief inspector reported as under:— “We have been engaged in general inspection work and early in June renewed all statutory notices. We find that considerable work ha 3 been done during tho past two months despite tho rather unfavourable weather experienced and fairly satisfactory kills have been, the result in most of the cases, but we are of the opinion that better results still would be obtained if settlers would feed better and heavier and also for a longer period, as now that the pest is getting scarcer they are not nearly so easily poisoned, but have to be tempted by clean feed and plenty of it. We have already made arrangements with the settlors in different localities where we consider it very advisable to have another general strychnine poisoning during the coming month. I regret having to again report that both your inspectors find it much more difficult to get satisfactory work done on properties where thero are only a few or scattered rabbits as to the owners of this class of property seem to think that odd rabbits do not matter. This is a mistake for it is these odd rabbits that keep tho supply up and until every settler realises that it is to his own and his neighbour’s interests to locate and destroy every white rabbit that he possibly can, we will not reach the goal we would like to.” The trustees who inspected the properties along the Oroua River were accorded a vote of thanks as were also Trustees Hair and Grice for their services in connection with tho recent rabbit boards’ conference. Trustees Wood and Kregor were appointed to sign the rate book for the current year. Accounts amounting to £lB3 13s lOd were passed for payment. A DISPUTED CLAIM.

The hearing took place at the Feildinj Magistrate’s Court yesterday before Mr J L. Stout, S.M., of a case in which th N.Z. Farmers’ Co-operative Distributini Coy., Ltd., proceeded against Frederic! James Mann, butcher, of Feilding, to re cover the sum of £192 12s 3d, as represent ing tho amount which the plaintiff com pany alleged was due by defendant on ac count, including interest. Defendant lodged a counter-claim of £3ol and alleged that, in the months of Novem ber and December, 1926, and in January 1927, he did on divers occasions purchase stock from _or througl tho agency of the plaintiff in tin name of defendant, but on bo half of defendant and one, F. L. Kerr, stoci agent, of Feilding, and that on or aboui December 10, 1926, defendant undertook tc instruct the fat stock buyer who might draft the different lines of stock so purchased to pay to plaintiff the full proceeds from all lambs drafted, and instructed plaintiff to handle and take charge of, as defendant’s agent, the remainder of the lambs not drafted as fats, at tho dates of delivery which the plaintiff agreed to do; and that plaintiff received tho full proceeds of the said lambs sold as fats and on the respective dates for delivery took charge of the remainder of the lambs for sale on behalf of defendant; and that plaintiff sold the majority of the lambs at a loss and had failed to account to defendant for all the lambs; and that plaintiff incurred unnecessary expense and loss in connection with tho handling and sale of tho lambs and, further, that plaintiff failed to exercise duo care and diligenco in the conduct of defendant’s business. Defendant alleged that Kerr denied that tho lambs were purchased for defendant and Kerr as partners and Kerr had refused tlo bear a half of the losses incurred.

Mr Graham appeared for the plaintiff company, and Mr Cullinano for deferjdttnt.

At tho opening of the case last court day, after tho account of tho plaintiff company had been formerly proved by Mr E. Hassell, general manager of the Farmers’ Distributing Coy., Mr Graham contended that, ns the onus of proving the counter-claim was on defendant, it wa3 for defendant to begin and prove his case. The Magistrate upheld this contention ftnd the evidence of defendant was taken until tho court adjourned. Defendant continued to detail his version cf the transactions at yesterday sitting of the Court and also his relations with Kerr nnd plaintiif company and was eross-exam-ind at length by Mr Graham. Numerous witnesses were then called and at the conclusion of defendant’s case, Mr Graham, in reviewing the evidence, submitted that the negligence alleged against plainttiff company had not been proved by defendant and counsol asked for a nonsuit. The Magistrate said he would reserve his decision on the non-suit point and the case ;was adjourned until the 19th inßt.
