CARRIER WITHOUT LICENSE. TAURANGA, Feb. 0. A Te Puke carrier. A. J. Andrews, with a wharf license at Tauranga ,_ was charged recently with a breach of the Tauranga Borough by-laws in plying for hire without a license. Reserved judgment delivered by Mr W. G. K. Kenrick, S.M., states that the wharf and To Puke being both outside the Tauranga Borough the position is that defendant receives the goods outside the borough and delivers rtheni outside the borough, but in doing so passes through the borough. On these facts defendant did not act contrary to the by-law, for he did not solicit for custom in the borough, nor did he carry goods between any two places within the borough nor between some place within the borough and some place without. The by-law made no provision for such a case. The case was dismissed, costs being allowed to defendant.
