ARGUMENT ON APPEAL.
HURDSFIELD v. JARVIS. Legal argument was heard at the Supreme Court this morning before Mr Justice Edwards on an appeal under the Justices' of the. Peace Act from the decision of Mr J. W. Povnton, Stipendiary Magistrate at Palmerston, in the case of F. Hurdsfield v. H. Jarvis. Whert the ease was heard before the Magistrate it was dismissed and from this decision complainant now appealed. The point of law involved was whether the evidence of appellant was sufficiently corroborated. Mr Cooper appeared for appellant and Mr C. P. Skerrett. K.C., with him Mr Fitzherbert, on respondent's behalf. A f lmorinrv 11 " V.
Mr Cooper appeared for appellant and Mr C. P. Skerrett. K.C., with him Mr Fitzherbert, on respondent's behalf. After hearing argument, his Honor in dismissing the appeal said he could not determine the case on the material before the court. The question that corroboration was not sufficient could be determined by the complete history of what happened before or after the alleged occurrence. He could not refer the case back to the Magistrate. He suggested the matter be brought again before the lower court and all facts brought out.
