Forrest, ox-member of Parliament, died a year ago leaving estate ralued at £103,137. whereof over £BO,OOO was bequeathed to crcat«> a trust for charitable and philanthropic purposes. Charles L. Forrest, his nephew, as th* only next of kin, sought the Court's ruling as to whether the trust was void on the ground of uncertaintv.

Tho Chief Justice, in delivering the Court's judgment, declared that Forrest had died intestate and the whole trust was void on tha ground of uncertainty. The whole of the money, therefore, goes to tho nephew upon his clearly establishing that he is the sole next of kin.
