JUDGMENT REVERSED. (Br Elkgtbio Teleqbaph—Copybiqht.j (Peb Phess Association.) MELBOURNE,. Oct. 4. The judgment in the case Varawa v. Howard Smith Company, in wMeh. the plaintiff was awarded damages arid costs, has been set i£mc by the Full Court. jf»» The above case, in which . Peter Fedorovitch Varawa, a Russian subject, claimed £20,000 damages for false imprisonment at Sydney in January, 1905, from the Howard Smith Company, was heard before Mr Justic'e A'Beckett and a jury of twelve, in the First Civil Court. On January 21, 1905, the following negotiations for the sale of the steamer Peregrine, the defendant company instituted proceedings against Varawa for breach of agreement, and he was arrested when leaving New South Wales, and held in Darlinghurst Gaol on a writ of capias for 11 days till security for £4000 was forthcoming. On this arrest, an action was successfully brought against the Howard Smith Company. The defendants denied liability, or that Varawa had any cause of action.
