CHARGE AGAINST A FOXTON CONSTABLE.
THE CASE DISMISSED.
Maurico Sweeney, police constable, was charged at the Police Court at Foxton on Friday with using obscene language while arresting Walter Herbert Anderson, for drunkenness, on July 3, 1908. Sub-Inspector O'Donovan was present on behalf of the police. Mr Reade defended Sweeney. It appears that Anderson resisted arrest, and a sovero struggle ensued between him and Sweeney, and during the struggle the latter was alleged to have used the language complained of. Anderson (the complainant), Charles (a flaxmill hand), Robinson, Walls (a labourer), and Webb (2) gave evidence as to th© language used. Constable Sweeney, for the defence, said Anderson threw him once, and he throw Anderson twice. He did not see either Charles, Robinson or Walls near when he was arresting Anderson. He asked the crowd for help, but they refused. He got off the ground and took his overcoat off, which Mr R. Moore held for him. Someone pulled him off Anderson while they were on the ground. Then Mr Moore advised Anderson to go quietly, and he went. Ho had been in the force at Wellington for 14 months, but there had been no complaints there. R. Moore, solicitor, said he held the constable's overcoat, and then advised Anderson to go quietly, and he went. Witness heard no obscene words at any time. The constable and Anderson had a desperate tussle on tho pavement, but tho crowd refused to help the constable. George Lee, a porter at the Manawatu Hotel, saw the scuffle, but heard no bad language. Hie Worship dismissed the case.
