In the case Rabone v TamaH (Native). — Claim, £15, the plaintiff was non-suited with costs. Mr Eaam appeared for plaintiff. The same plaintiff m three other similar cases against Maoris, got judgment with costs m each ease. J. McLellan v. Gaseoiijne. — Claim, £80. Judgment for-£25 and costs. In the case F. T. Collins v. A. G. Allen.-— Claim, £10 Is, money lent. Plaintiff deposed that the money was obtained from him by defendant on the understanding it was to pay Mr Koe for board. A promissory note m favor of Gr. F. Roe, given on the 16th of October, was here produced. Witness staling tl.is was a final settlement with Roe, and that, at Ihe time, he received the money from plaintiff he did not owe Roe anything. ' The Bench made the following order on the "round of liability having been incurred by fradulent representation on the part of defendant at the time of receiving the ivuney, viz. : — That the amount be paid at the rate of £2 pt'r month, first payment on 12ih June next, and failing to comply with this order the whole amount to be due and payable forthwith, m default 10 days' 'imprisonment m Wellington G .01. L. G. WVst (agent for T. S. Schlager) v. W. Pawson. — Claim, for rent, £3 6s 6d. < .'■ Defendant contended that certain repairs which had been promised when the bouse was first taken bad never been effected, and that lie eventually left the premises as he could not get the landlord to make the necessary improvements. The plaintiff stated that the promise 1 referred to had been made on tho understanding that the rent should be paid regularly,: this had r.ot.been done, and therefore he contended he was not entitled to keep his part of the contract. The Bench gave judgment for £3, and costs, 7s. The Court then adjourned.
