Defendant is a shipowner living at Riyerton, South Dunedin- He. ordered certain timber from plaintiffs, who for- " warded a consignment shipped at F^xton, but which on arrival at .Duricdin was found on inspection not to be according to size ordered and of inferior quality. Defendant therefore refused to take delivery of the timber and also to accept draft when presented. Defendant who is also captain and owner of the vessel thai brought the timber down to Dunedin, requested payment of .freight, and threatened if it was not forthcoming he would sell the timW. . The plaintiffs m order that the tiniber should not be sold for a mere nothing paid ; the freight and . requested 'the defendant to. pay the amount which he refused and hence the" present action. After a lengthy hearing, the R.M. reserved jndgment.
