Yesterday morning at day-break, a whale was seen disporting itself m the arnlf, distant about seven miles from the Thames, and after three or four hours' hard work, the men employed m the steamers and fishing boats succeeded m forcing the animal up the Thames River into shoal wafer, where it was soon killed. It measures 75 feet m length. . Auckland, April 28. Mr Justice Gillies delivered an im* ' portant judgement yesterday under the Land Transfer Act. Jonathan Brown had bought certain lands from natives on the East Coast. Papers, including j the transfer, went down with the Ss. Taranaki when she sank on a rock near i Tauranga. He applied to the District Land Regiatar to register a memo, of the transfer. The register refused re- • fused, as no suci instrument was mentioned m the Act. He next applied to the Supreme Court for a rule nisi calling on the Register to show cause why he refused to register the instrument. Mr Coster showed cause against the rule. His Honor, m giving judgment, said it was a great hardship m the present instance that no provision was made m the Act for cases where the transfer was lost. It was probably a casu3 omissus , but the language of the Act must be construed strictly. The refusal of the. Register was therefore confirmed. The s.s. Hinemoa takes over 2000 stand of old arms to Wellington from the Auckland armory. The German warship Hyena has lost several men during her stay here, by desertion,
