Appeal from a decision of the Resi* dant Magistrate at Fielding, giving judgment for the respondents for £80 for the value of wheat bought by sample, but which, through getting damp before threshing had turned oat bad. Mr Ollivier for the appellants ; Mr Gully for the respondents . After some discussion the case was remitted back to the magistrate, to amend his statement by finding whether the whole, or whai p.\rt of the wheat delivered was equa to sample ; and to reassess the damages on the footing of the difference of value at the time of delivery between tLe then i market value of the wheat delivored and wheat according to the sample, the question of Co3tß being reserved.
