(Before E. W. Porritt, Esq., S.M.) UaG 1 S'Jli A TE r S COURT, NASEBY. Tuesday, 24 th January. Wandering Cattle. J. F. O'Mailey was charged by W. Beath with having, on 15th January, allowed a cow to wander in a public place—-to wit, the the Naseby Palmerston main road. Mr Davey appeared for the informant, and Mr McNeil for the defendant. Defendant pleaded Not Guilty. The information was laid under section 4, Bubßection i, of the Police Offences Act, 1908, which provides— Every person is liable to a fine not exceeding £lO who, in or upon any public place, permits any cattle to be at large, or without proper guidance, jor to wander, or to be . herded or j grazed, etc. j W. Beath gave evidence that at 6.30 on the morning - in question he saw a cow wandering on the road. One of O'Malley'a boys drove it home. He knew the cow was defendant's because he had frequently seen it in his yard; had also seen defendant drive it home. Mr McNeil said there was no evidence jthat it was defendant's cow," or that he had permitted it to wander. At anyrate it was a very trivial matter. Defendant admitted that he had a red and white cow. Did not put it on the road or instruct his boys to do so. It was kept in a yard at night and turned out on the Kyeburn run during the day. Hi'b Worship - said the matter was very trivial but an offence had been committed. Defendant would be fined Is, with costs 7s and a solicitor's fee of 21s. - - Civil Cases. J. R. Kirk (Mr Davey). v. J. T. Beattie.Claim, £3 3s lOd, of which £2 10b had been paid on account.—Judgment for balance of 18s lOd, with costs £1 10s. E. C. Cutten v. W. Bromiley.— Claim, £1 14s.—Judgment for amount claimed with 5s costs. F. W. Inder (Mr McNeil) v. John E. M'Lean,—Claim £5 10s. —Judgment for amount claimed, with costs of court 8s and solicitor's fee iss 6d. James Brown (Mr Davey) v. James Crawford, jun.—Claim, £4 2b 2d—a judgment summons.—Defendant did not appear, and an order was made for the amount, with 5s costs, to be paid within 14 days; in default, seven days' imprisonment in Naseby gaol.
