(Bkkoke J. M'EnniS, Esq., S.M. And -:. Waudkjj.) MAGISTRATES COURT NASEBY. Monday, May 18t.ii. Police v John Beattie, jun. (Mr Kirk).—Charged with' having stolen from H. Webb, at Itanfurly, on the 16th insb three £5 pousd notes nnd quantity of silver amounting iu all to £ls 10s. Constable Leinm gave evidence of arresting licensed on Sunday night when he hadjEl 8s in his possession, and accused took him to where he bad two £5 notes in the show ground and £2 lis at the back of Brown'* shop. The £p he changed was found at Mr Ryan's Hotel, Naseby, by the police, Webb on Saturday through changing his clothes to come to Naseby hit his purse on the table. On return ing from Naseby at midnight he missed his money aiid he woke accused and asked him if ho bad seen it, He said no. They slept in the hut together.
Accused pleaded : guilty, and Mr Kirk in extenuation' said that he went itito the hut and saw the purse lying on .the table »<nd knowing who it belongedl''to knew it would be folly tu leave it there au'd took it intending to restore it to Webb-then. In Naseby he spent his own money in drink and then changed one of Webb's £5 notes when under the influence' of liquor. .'..*"
The Magistrate after pointing out the seriousness of ilia offence- fined him £o on the assurance tbat the £1 lis speut would be paid and a pro hibition order taken out against bim ; Mr Mitchell, accused's employer, gave him a good character. Mrs Jlyan. who changed the £5 was represented by Mr McNeil.
