Beattie (claim, £l3 Us 3d; conntcr-claiiu, £22 1 (Is) was continued. On the suggestion of the' magistrate, counsel for both sides a-freed that all the evidence heard in connection with the claim should apply to the counterclaim. | It. Beattie stated that he started to work on the Otago Central In June, 1901. He produced a miner's right he said lie took out four days liefore he went to, work. It was dated 13th-J line. He also produced a " "paper which he said contained an extract from the books of his foreman showing the date. He had no i dealings with Moore about the house before he started to work for the Government. He bought the property as itstood for £GO. No time was mentioned for thr payment of the money, nor was anything said about, interest. Witness also gave evidence of dates of payment, which bare already been mentioned. On one occasion he asked Moore for the rent he had been collecting, but was.told.to mind his own business. He al-id swore positively that the payment in June, 1902, was for £lO, and not for £2, and nave his reasons at length for so saying, and when he disputed with Moore about the amount, Smith owned up that he had got the money. The claim was made up of:—Loss of three weeks' wages at 7s per day, £6 6<; three weeks in the hospital at 30s per week, £4 10s; and the balance for special damages.— In this case His Worship gave judgment for plaintiff for £l3 10s, made up as follows: —Hospital fees, L 4 10s ; wages (12 days at 5s 6d), L 3 6s; special damages, LI; court fee, LI 6s; Dr Church, LI; two Chinamen (5s a day), ilOs; interpreter, LI la; solicitor's fee, LI 6s.
