Claim £2B 7s. B|d. Claim was for water supplied, and for discharging into Company's race, for mining Jim-pones. On request of applicant hearing was adjourned to the 26th of May, to enable John Tait, whose name was added ,-as a co-defendant, to be served with summons. Extended Company T.John and Joseph Orcighton.—Complaint iii ihis eiw was that the defendants, between the 7lli and 271 h days of April, 187(3, both inclusive, unlawfully interfered with the tail rac •of the Company in Main Gully, NHscby, by erecting a wing dam abutting on the said tail race, and by diverting a portion of the water without the sanction of the complainants or the authority of the Warden. After a protracted hearing, in which it appeared that ilie injury complained of was morn a matter of assertion of* right than of damage, the Warden reserved judgment to the 26(h Mny. May 13. "Pavid M'Creody v. Samuel Veale.— Complaint in this ease was—That the defendant, on or or about the Bth day of April, did interfere with a certain roadway or track in common use at Kyeburn by cutting a tail race through the same, ■whereby the said roadway or track has been rendered useless, without the authority of the Warden. After both sides had been- heard at considerable length, complaint was dismissed, with expenses of five witnesses, £4 15s Od; and 10s. '■oats of Court. In this ease a rclearing has been granted for Thursday, June Ist, at Kyeburn Post Office Hotel—applicant to pay the .uobUi of such reLcariag, and assessors.
