WARDEN'S COURT.-Nov. 13.
(Before H. W. Robinson, Esq., Warden.) Brookes and Party v. Hit or Miss \Tater Race Company (Registered.)— This was an action to' recover the sum of £l5O for (i:?ma«re alleged to have been caused to the race of plaintiffs by the bursting of a dam of defendants on Surface Hill. Mr. Boss for plainMr. D. F. Main for defendants. Ihe warden, together with the assessors, having visited the ground, the evidence was gone into at considerable length. Verdict for plaintiffs, £l2O, with £9 9s. costs. Mr. Main asked the leave of the Court to appeal, which was granted.
