NORTHERN MURDER TRIAL.
JURY FAILS TO AGREE,
Auckland, August 10. After a retirement of four hours the jury failed to reach an agreement in the murder charge against Ilcta Fred Gardner, a half-caste Alori hoy. A new trial was ordered for next session. Gardner was charged with murdering George Crew at Ruatnngata on May 27. Air. Justice Smith presided. When the case Avas resumed today his Honour said lie had decided that the last statement made 'by accused to the police before his arrest w’as inadmissible as evidence. Addressing the jury, counsel asked them to dismiss from their minds everything except the evidence. ■ There Avas no evidence to connect the boy Avith anything except petty thefts, and it was not proved that he Avas over near the dead man’s hut.
'Summing U p, the Judge said there Avas evidence that accused was subject to rapid emotional changes, Imt none to prove violent tendencies. There Avas no definite evidence to connect accused with the striking of the Ijloav that caused death. The jury must he satisfied that it Avas accused Avho Avielded the axe before they convicted him.
