FERRY LEASES. la. pursuance of the provisions conned in " The Counties Act Amendmt Act, JBBO, the County Council ' the County of Manawatu, iiHhe ovincial District of Wellington d Colony of New Zealand, hereby /& notico that they are piepared to seive tenders from persons willing become lessees of the ferries over a Manawatu River at Foxton and at c Lower Gorge (the lease of the >xton ferry to include the Foxton blic pound, with the rights and apirtenances thereto belonging), tother with all buildings, gear, boats, mts, and all other appliances and purtenancea whatsoever to the said rries respectively belonging or apperining. And that the proposed terms td conditions of such leases are as Hows : — Each lease shall be for a term of yeara, computed ftom tho 31st day March, 1881, and shall contain the tual covenants— for payment of rent larterly iv advance, the first payent to be made on the execution of c lease; for payment of all rates id taxes ; for keeping the demised emises in repair ; and for the insurice of the same in the full value eieof; also a covenant that the 3see shall nse and work the ferry in proper manner, and abide by and nform to all laws now in force, or hich may during the continuance of c lease be in force relating to public rries ; and also a proviso foi re entry r the lessors (with full power to enr upon and take possession of the : mised premises, and of the punts, ;ar, nnd all other appliances of or dongiug to the feny, and to work c ferry at the expense of the lessee his sureties), on nonpayment of nt within 8 days after it becomes io ; or on the breach or nonperformice ot any of tho lessee's covenants ;
' on his doing any act contrary to c laws of New Zealanl relating to tries ; or on his becoming banktupt, solvent, a lunatic, or dying, or otherise becoming incapable of nianagg, or neglecting properly to manage id conduct the ferry. And also a vonaut not to assign the lease, or iderlet the ferry, without the connt in writing of the lessors. Each lease shall also contain the llowing covenants, provisoes, condU ms, and agreements, that is to say : 1. That the lessee shall provide at s own expense all gear, boats, punts, id mateiials not included in the ase which in the opinion of the ssors or their engineer shall be ;cessary for the efficient working of c ferry, and shall provide at his vn expense all requisite assiscance, id also such lights to be placed in eh positions, and to be kept burng during such hours as the lessees cr eir engineer shall direct. 2. That the lessee shall keep in orough repair and condition to the tisfaction of the lessors or their enneer the approaches to the ferry on >th sides of the river as follows, that to say — the approaches to the ower Gorge ferry from tbe gate on c east side of the river to the punt, id on the west side of the river from c County metalled road to the punt ; id tbe approaches to the Foxton rry from Burr's corner to the punt, id from the punt on tbe south side the river to the sea beach, and ;ep all sand cuttings oleaned out and mes scrubbed where the lessors or eir engineer direct. 3. That the lessors, or their sermts or officers, shall at all times iring the continuance of the lease ) at liberty to enter upon the jmised premises, and inspect the orking of the ferry, and the appii' ices thereto ; and the lessee shall at s own expense cany out any alterions or instruotions as to the work-
g or management of the ferry as .c lessees or their officer shall reet. 4. That all punts, boats, gear, and aterials provided by the lessee durg the continuance of tho lease tall be deemed to be the property the lessors. All such property hich shall be included in the lease tall be valued upon the lessee enring into possession and the same getber -with any additional plant, tats, gear, punts, or other materials pplied by the' lessee shall upon the piration or other sooner detexminion of the lease be again valued td if the value ofthe whole of such operty shall then be in excess of at whioh is included in the lease, c lessors shall pay the amount of eh excess to the lessee ; but if the bole of such property shall, on the itennination of tne lease be of leas lue (after allowing for reasonable sar and tear) than that inoluded in c lease, the lessee or his sureties all pay to the lessors the difference >tween suoh values. 4a. That the lessee and his sure* ss shall hold the lessors harmless id indemnified from and against any aims for compensation made by any irson or persons by reason of any bs carriage or personal injury susined by him or them, or his or eir goods and chattels, in conscience of the negligence of the ssee or his servants in the proper anagement and working of the rry or otherwise ; and also against I damages, costs, charges, and menses which iho lessors may Busin or be put to in any Court of law '.otherwise with reference to such Mm*
