PUBLIC TRUST CASE,

IN RE SAMUEL HUGGART, DECEASED.

WELLINGTON, April 30. Argument was commenced in the Court of Appeal this afternoon ,in a case received from the Supreme Court in re Huggart (deceased) and Jenkins y. the Public Trustee. The question is whether an order by deceased, Samuel Huggart, on the Public Trustee to pay <to the Bank of New South Wales or order a sum of £2500 was good as a 'testamentary instrument.

Sir John Findlay, X.C.1, and Mr Hoggard appeared for Jenkins, manager at Blenheim of the said bank, and Mr Skerrett, X.C, and Mr J. W. Mac Donald for the Public Trustee, and Mr T. F. Martin for persons interested under deceased's will, made prior to the giving of (this order. Argument had not concluded when the Court rose.
