CLAIM FOR POSSESSION.
RACEHORSE INVOLVED. ■ [Per Pres* Association.) HAMILTON, December 10. At the Supreme Court to-day Frank! Morley sued John Hetit for possession of the racehorr© Tamarioa, which recently disappeared from Te Aroha, and £3OO, alleged damage*. Hetit counterclaimed for £2OO for alleged damages and "wrongful detention. Morley claimed that he leased the horse to Hetit for tw‘o years, and was to receive half the winnings. Hetit claimed that the horse was given to him unconditionally by Morley. The Judge commented strongly at one stage on Morley' n evidence, and said it waa a dishonest thing to claim possession when he ad-_, mitted under pressure of cross-examina-tion that he knew the whereabouts of* the horse, having received possession of the some at 4.20 on the morning of its disappearance. The Judge also asked Moriey how couM he expect him to believe his evidence when he ad- . mitted telling this to people. The jury returned a verdict for Hetit in both cases, Hetit to receive the horse. No damages were awarded. 1
