MAGISTRATE’S COURT.

CHRISTCHURCH. Mr S. E. M’Car thy, S.M., presided at yesterday’s sitting of the Magistrate’s Court. A Urst offender for drunkenness wan hned 6s, in default twenty-four hours’ imprisonment. An elderly statutory first offender was lined £l, in default, seven days’ for a similar offence. Francis M’Cluskey, similarly charged, was fined £2, in default seven days’ imprisonment. William Jolm Gwens was sentenced to cne month’s imprisonment for using obscene language in Elgin Street, on Wednesday. On a further charge of drunkenness ho was convicted and discharged. George McCarthy (Mr Thomas) appeared on a charge of having, on October L 7, at Wellington, received from ° ne liiacklock tho sum of 14s Hid, on terms requiring him to account for the same- to the New Zealand Automatio Bakories, Ltd. ? which he failed to do, thereby committing theft; also that ho did, on October 9, 1919, steal a watch valued at £6, the property of George Greening. On tho application of tho police a remand to December I. was granted. Bail was granted, accused in £SO and two sureties of £25 each, or ono of £SO. In each of tho following cases judgment with costs was entered for the plaintiff by default: —J. and A. W. Munnings v. William Thomas, £1 12s; Dominion Motors, Ltd. v. G. A. Oakley, £137 11s Id; J. P. Elliott v. Robert Leggett llaraitiana, £7 2s 6d; Andrew Lees, Ltd. v. H. A. Saggers, Os 2d. Arthur Arbnckle Napier was ordered to pay T. 0. Breen (Mr Cuningham) £l6 Os 2d, on a judgment summons, in default two months* Imprisonment. Evelyn Clark (Mr Cuthbcrt) proceeded against A. L. Tucker (Mr Sargent) claiming possession of a tenement, situated in Beresford Street, New Brighton; also £5 rental. The case was adjourned till the following day. (Before Mr E. 0. Lowey, S.M.) Sarah Emily Clarkson, widow, and Ernest Webster Waller, timber merchant, both of Christchurch, executorß of the will of W. A. P. Clarkson, lato of Christchurch, architect, deceased, proceeded against Henry Berry ana Co., of Christchurch, merchants, claiming the sum of £ISS 13s, architect's fees in preparing sketch plans of proposed buildings tor tho defendants in Wakefield Street, Wellington. The defence was that the plans in question were merely probationary, the late Mr Clarkson having prepared them in anticipation of being engaged to carry out the work. He died, howovor, before the construction of the buildings was authorised by the principals of the defendant firm, in Melbourne and another set of plans were used. Under the circumstances, the. Magistrate said, he could only award judgment for. tho defendants. It was unfortunate that Mr Clarkson had died before the work was authorised. Judgment was accordingly entered for the defendants, witli costs-
