MAGISTRATE’S COURT

CHRISTCHURCH. Mr V. G. Day, S.M., presided at yesterday's sitting of the Magistrate’s Court. Three first offenders for drunkenness were each fined ss, in default twentyfour hours' imprisonment. John Joseph Mulheistcn Arnold (Mr Thomas) on a charge of using obscene Inngungo to his wile wan fined £1 in default one month’s imprisonment. Martin Crosbio Moran (Air Thomas) pleaded not guilty to the. theft of a bicycle valued at £lO, the property ol Alfred Douglas. After hearing evidence at some length the Magistrate l dismissed the charge. John Walker, charged under tramway by-law II with not producing his ticket wimn requested to do ho, was fined 5s and costs. Charges of threatening behaviour and failing to fender his fare to a tram conductor were preferred against H. Parry, who did not appear. Mr L. A. Dongall appeared for the complainant. E Thompson. A fine of 10s and costs wits imposed on each charge. For speeding with a. motor-ear Arthur Lancelot Cyril Watkins was fined £3 and costs, and Percy Hazeldean £2 and costs. Charles Henry Jones, similarly charged, was ordered to pay costs 7s, and "was also ordered to pay a like amount on a charge of failure to notify chango of ownership of a motor-ear. George Rutherford, for failing to notify change of ownership of n motorcar, was fined 10s and costs. Charles A. Aston (Mr Thomas) was convicted and ordered to pay costs on a charge of cycling without a light. James Stewart (Mr F. S. Wilding), for damaging a bicycle by driving on the wrong side of the street, was ordered to pay costs 11s, witnesses’ expenses £2, and the value of the bicycle, £lO. On a charge of not clearing growing matter from a water-race in compliance with the Selwyn County by-law 22, John Tisch (Mr Macdmigall) was fined £4 and costs. Mr Sim appeared for the informant, Sydney Robert Wright.

(Before Mr S. 75. M’Carthy, S.M.) Further evidence was heard in the case Harold Dean Greenwood, slieepfnrmer, late of Omihi. and Sophie Greenwood (Mr Twynenam), v. James M. Kelly, of tho Government Valuation Office, Christchurch (Mr Johnston), plaintiffs claiming £l9B 15s fid as damages. The plaintiffs claimed that, on tlie evening; of July 7, on the road between Christchurch and Omihi, a motor collision ocourred between the plaintiff’s car and that of the defendant, owing to the defendant driving on the wrong side of the road, and handling his car negligently. The sum of £l7B los Gd was claimed in respect of the plaintiff’s ear, and £2O in respect of injuries sustained by the female .plaintiff. The defendant coun-ter-claimed for £134 11s, alleging that he was only the bailee of the car he was driving, and had undertaken to return it to the owner in good order, and that the accident was brought about by plaintiff haring driven Ilia ear in a reckless manner, with dazzling headlights. Decision was reserved. ASHBURTON. Mr 75. D. Mosley. S.M.. presided at the Ashburton Magistrate s Court yesterday. John Hunt, charged with stealing a bicycle valued at £o, pleaded guilty and elected to l>o dealt with summarily He was sentenced to two months’ imprisonment. James Joseph Dolan, charged with a. breach of a prohibition order, was fined 10s with costs. For speeding at Tinwald, Thomas Morland was fined 20a with costs.
