NEWS AND NOTES. ; Amongst the visiting horses who will ffce racing at Addington on Saturday is ■'the trotter Koraki. So far this season ,*he Otago-owned trotter has raced most Consistently, without winning, though he has been three times in second place -and once third. Although Dean Dillon is an acceptor for the big two mile harness event at Addington on Saturday, it must be remembered that he was one of the unfortunate ones in the smash-up at the For- . burv Park Club's meeting, and this 'jnav affect his chance. -On the first day ■at Forburv he was out in front nearly the whole'way, and then failed, whilst he was in a pood position at the time of the accident. Although Dean Dillon has secured over £6OO in stakes this season he has only succeeded in winning one race, the rest of his earnings being made up of place money. Mintson has raced consistently this season without much luck. Ho has only won once, but ho has been placed , third on four occasions. Emperor has won two races this seaBon and oyer £SOO in stakes. He put tip a good performance in the mile saddle event on the first day of xhe For- , bury Park Trotting Club's meeting, and was a hot favourite for the final event at the meeting, run over the same distance, in which he was prominent early, but finished up in fifth pi ace .; The trotter Whispering Willie, who performed successfully against the best pacers at the Auckland Trotting Club's meeting at Christmas time, raced bad'Jv at Forbury Park, failing \ to settle down to his work in either of his races. The trotter Itosie M'Kinney, who raced unsuccessfully at the Forbury Park Trotting Club's recent meeting, has been mated with Nelson Bingen, and will not be raced again this season. '"' During the earlier part of tho season Rosie , M'Kinney, who is far from being a sound mare, won two races and was twice in Becond place. ,fche' has won £335 in stakes this racing season. The trotter Peter M'Millan is at present suffering from a severe attack :;of'strangles. For some timo prior to being attacked with the malady it wau .thought that this promising trotter was affected with his wind, so it is to bo hoped he will come through his illness ■ without serious after effects. ' Barrister, who won tho Autumn | Hurdle Handicap at the Dunedin Jockey Club's meeting, is a half-brother to Lochella, winner of the Grand National Steeplechase. He has not had >a great deal of experience over ob- : stacks', but he is a bold jumper, who is likely to see a better day. The Dunedin Cup, as was generally expected, resulted in an easy win for ?■ Amythas. He lay in a handy position most of the way and drew out in the 1 straight to win in hollow fashion. It was an impressive performance, and removed all doubts as to tho claims of Amythas to rank as a high class three-vear-old. He is, in fact, clearly established as the best of his age in the Dominion this season. Nightraider, who followed him home in the Dunedin Cup, was staying on well- and to this he owed his position, as Warlove and Rose Wreath were stopping at the end, after being responsible for a sound pace.. Winter Wind did not shape well in the early stages of the Dunedin Champagne Stakes, but he finished with the determination which has marked the close of nearly all his races, and lie 'won easily. He appears to be a lazy • customer, but, he is a bold galloper, who is likely to play a leading part in other events before the season closes. Though lacking the brilliancy of his Stable companion, Moorfowl, his stamina is fully established, and that w » u serve him now that longer journeys Jiave to be tackled. FAERIE KNIGHT CASE. JUDGMENT FOR PLAINTIFF. "A blemish which does not affect a horse's racing capabilities is not an unsoundness in respect of a horse sold for racing," said Mr S. E. M'Carthy, 5.M.,. when delivering reserved judgment at the Magistrate's Court yesterday in the case in which Robert Walker Franks (Mr Johnston), horse (trainer, of Sockburn, sued Reginald 'Acton-Adams (Mr M. J. Gresson), of Dunedin, for a sum of £123 in respect of the sale of a racehorse known as Faerie Knight. The sum of £123 was made up of £IOO, the purchase price of the horse, and £23, cost of keeping the anjmal after defendant had returned it to plaintiff on the ground that it was not up to representations- Plaintiff had an alternative claim, in oase the sale was not upheld, for £52 2s, for injuries which ne alleged the horse had sustained whilst it was in defendant's possession. The Magistrate said that the conclusion was irresistible that the injuries complained of took place whilst the horse was under defendant's control and care, and he and his trainer, C. Christie, could best explain why it was returned to plaintiff without a word about the injuries. Further, after the horse was returned to the plaintiff it was severely tested in the presence of three veterinary surgeons, who pronounced it sound in wind and limb. It followed that the statements made by defendant and his witnesses that the horse had bone spavin and was brokenwinded were untrue, as also were the statements that the injuries, with which the horse was returned, happened on the railway journey. The defendant's , trainer, who had authority to accept or reject the horse, took delivery oh March 20. He promised on March 21 and again on March 24 to give plaintiff a cheque, but he failed to keep J&ese promises. The horse was rejected

on April 4. Even assuming that the j horse was not according to warranty the defendant and his trainer had ample opportunity to examine and test it before March 21. Certainly a rejection on April 4, after the horse had suffered severe injuries whilst under defendant's control, concerning which defendant and Christie gave an untruthful account, was too late. Up to April 4 the defendant had, without rejection, retained possession after the lapse of a reasonable time, and he must be deemed to have accepted within the meaning of the Sale of Goods Act, 1908. This was on the assumption that the horse did not satisfy the warranty. " I must, however, find that the horse, when it was delivered to the defendant, did answer the warranty. Defendant had, therefore, no right of rejectionTho plaintiff did not warrant that the horse was a future winner of a Grand National, but only that, if efficiently schooled, he had a reasonable chance of becoming a steeplechaser." With regard to the claim for keep and attendance the defendant could not under the circumstances complain that the plaintiff took oroper care of the horse.
