DOMINION CEMENT CO.

SAtjE OF ASSETS COOT’IBMED. The affairs of the Dominion Portland Cement Company, Limited, came again before Mr Justice Cooper at the Supreme Court at Auckland on Friday, when Mr J. R. Reed, K.C., on behalf of the liq lidator, moved for a formal order confirming and validating the sale of the company’s assets by the liquidator in January last to Mr E. Gerard, receiver for the debentureholders, and authorising the liquidator to affix the company’s seal to the documents connected with the sale. The motion was made necessary by the recent order of the Court that the liquidation should oontinuo under the Court’s supervision, such an order involving a review of the liquidator’s acts previous to the order being made. Mr Reed put in an affidavit by tho liquidator (Mr F. T. Eyre), in which the latter stated that the purchase' price of the assets was £137,600, and that on April 3 the assets were again sold by Mr Gerard to Mr 0. Nicholson, as trustee for a company to bo formed under the name of Wilson’s (N.Z.) Portland Cement Company, Limited This company was incorporated on May 31 following.

No opposition was offered to the motion by the various interests concerned, all of whom were represented by counsel, and his Honor accordingly made tho order.

Dr BamfoTd, for the shareholders who originally petitioned for the compulsory winding-up of tho company, then asked for the sine die adjournment of a motion to have the company’s accounts inspected, and this was also granted by tho Judge. It was stated that tlio question of costs in the action, which had boon left open, had been settled between the parties, and no order in respect of them was required.
