MAGISTRATE'S COURT
CHRISTCHURCH. Mr T. A. B. Bailey, S.M., presidea at the Magistrate's Court yesterday. Andrew Anderson, a third offender, was fined 20s for drunkenness. Patrick O'Malley was charged with assaulting his wife, Eileen O'Malley, with intent to do bodily harm. Thu case was reduced to oho of common" assault. The police stated that the matter was a family quarrel, and tho woman was not as badly injured as was feared. It would be sufficient if the expenses could bo recovered, amounting to about £2 Bs. The accused pleaded guilty and was ordered to come up for sentence when called on, conditional on payment of expenses. Judgment for the plaintiffs with costs was given in the following undefended cases:—William Withell v. Arthur E. Otway, £lll 3s 2d; James Knight v. Arthur E. Otway. £66 9s 7d; Pritchard Jones and Majtland v. Michael Quinlivan, £5 (Is; J. E. Tooley v. Ella Brunt, .£3 15s; Massey-Harns Company v. Thomas Small, £l7 5s 4d. W. Strange and Co., Ltd., V. W. G. Rashleigh, £44 17s 3d. In the case of J. W. M'Clintock v. Mrs J. Newill, a claim for £3 10k for the purchase of a bicycle, the defendant said that she had sent word to M'Clintock to take the bicycle back. Her husband was at the front- The bicycle had only been ridden for three months, and was as good as new. Tho plaintiff said that. Mrs Newill had bought the bicvele since her' husband enlisted. The Magistrate gave the Elaintiff his choice of tho return of the icycle or judgment- He elected to take judgment, and it was entered accordingly. Alexander Gunn (Mr Mosley) claimed £5 T 1 from James P. Mathieson (Mr Hum, i'or ropairs to a house at 240. Wilson'R Road, owned by the plaintiff and tenanted for three years by thr defendant. The defence was that there had been a tenancy at will, without covenant to repair. Judgment wa* given for the plaintiff for 20s.
LYTTELTON. Mr W. 0. Cleary, J.P., presided at the Lyttelton Magistrate's Court yesterday. Victor Samuel Fraser, who appeared on remand on a charge of stealing jewellery to the value of £9, the property of Man- Hume, a passenger by tho steamer Maori, was further remanded till the following day, to appear at Ohristchurch. ASHBURTON. Mr H. W. Bishop, S.M., presided ax the Ashburton Magistrate's Ctfurti yesterday. Frank Thomas M'Cormick was charged that on or about October 8. at Longoeach, ho did steal a watch, valued at 10s, the property of James Garson. On the application of the police a -remand was granted until Thursday next. Charles Philip. Welsh was charged that on October 17, at Ashburton, when questioned by Constable Dunn as to his membership in the New Zealand Expeditionary Forces, be did answer such questions in a false manner. Defendant stated that when questioned by the constable ho was confused. Constable Dunn said ho met defendant on Wednesday, and asked him whether he was registered. Defendant replied in the affirmative, and said he was drawn in the ballot, and that ho had been medically examined at parlieiq and rejected because ho had a bad leg. In answer to the Magistrate, defendant. stated that he had not been medically examined. Constable Ingram also gave evidence, stating that defendant did all he possiblv could to dodge service. Defendant, in evidence, said he had reason to believe that he would not pass as fit for service. The Magistrate. ■"All tho more reason why you should have presented yourself or exami £ tion/ Defendant was fined £o, and the police were auihorised to hand him over to the military authorities..
