MAGISTRATE’S COURT.

CHRISTCHURCH. Mr W. H. Cooper, J.P., aud Mr C. P. Agar. J.P., presided at the Magistrate’s Court yesterday. Michael Finucane was charged that, on September 13, 1909, at Wmton, he did forge the name of M. O'Brien to a cheque for £6 4s, and did cause Mrs Finnigan to act upon it as if it wore genuine. Mr Cassidy who appealed for the accused asked for a lemand to Amberley on December 8. The remand was granted. William Organ was charged with stealing at Halswell threa fowls, to the value of 10s 6d, the property of Alexander Angus. Accused was fined £1 and costs, and ordered to refund 10s 6d, the cost of the fowls, in default seven days’ imprisonment. LYTTELTON. 'Mr H. W. Bishop, S.M., presided yeseterday at the Magistrate’s Court at Lyttelton. Patrick Harnett was charged that, on November 3, being a person other than the licensee of tho. British Hotel, ho did supply liquor to John Finn, a person already intoxicated. James Cornelius Harnett, tho licensee, was charged with permitting drunkenness on tho prein'ses and also with having sold liquor through Patrick ready intoxicated. Mr Hunt appeared for the defendants, who pleaded not guilty. After ovideoice had been given by Senior-Sergeant Ryan and Constable Lloyd, Air Hunt submitted that as there was no evidence to prove that drunkenness had boon permitted, and that as there, was no evidence of sale the case against tho licensee could not stand. He quoted authorities on the matter. Mr Bishop stated that he did not think there Was a strong case against the licensee, but there was undoubtedly one against the barman. Under the circumstances Mr Hunt said lie was prepared to enter a pica of guilty as far ns the.barman was concerned. The Magistrate convicted the barman and fined Turn £5 and costs. The charges against tile licensee wero dismissed.
