TIMAEU. Thursday, Feb, 11. (Before his Honor Mr Justice Denniston and a jury of four.) Civil Case. —T. Eattiay v. S. Green, claim for specific performance of contract and £250 damages. Mr White for plaintiff; Mr Raymond for defendant. This case, which was partly heard on Wednesday, was continued yesterday. The plaintiff claimed that he purchased through defendant’s agent, Mr Moss Jonas, his farm of acres of land at Deep Creek, Hook district, for £4789 2s fid. Plaintiff payed a deposit, but defendant refused to sign the transfer. The defendant’s case was that he objected to the sale and so tho present action arose. After hearing evidence the following issue was placed before the Jury Did M. Jonas sell as authorised agent for defendant? Answer: Yes. Ilia Honor reserved his decision, Mr White to move, in Banco , for a decree; defendant to execute a transfer and give up possession of the land, and his Honor will then consider the matter of costs. IN CHAMBERS. Simmons v. Simmons. Mr White for plaintiff, Mr Perry for defendant. This was a further application to consider partnership accounts, the parties having dissolved some time since. This case came before the Court about nine months ago. Hia Honor, after hearing argument, decided to look into the affidavits, and allow Mr White to move at Christchurch to enter up judgment for his client. Tho Court then rose.
