MAGISTERIAL.
CHRISTCHURCH. Wednesday, Feb, 10. (Before E. Beetham, Esq., E.M.) False Pretences. —Peter Jensen was charged with obtaining 6s from Christopher Deering by means of false pretences at Christchurch on Feb. 6. The charge was admitted. Sergeant-Major Mason, in answer to the. Bench, said that the accused went to Deering’s private house and asked his daughter to buy some wood, which he was hawking. This she refused to do. lie then went to Deering’s shop, and represented to him that he had sold wood to his daughter to the value of 6s, and he was paid that amount. In answer to the Bench, Sergeant-Major Mason said that the accused had previously been convicted for the same class of offence, and though his time had expired he had not been formally released, as he still owed 8s 4d, part of the costs of the previous case, which he had been ordered to pay by instalments. The Magistrate said that the only jurisdiction he had over the lad with regard to the former case was during the time of his probation. If he was in default with his costs he should have been arrested during his term and brought before him. In answer to the Bench, the accused said his age was seventeen, and that he was drunk when he went to Deering’s. Mr Deering: “ That is not so, your Worship; the accused was quite sober when he came to me.” The Magistrate said the accused did not appear to know what doing that kind of thing would result in, and he would have to be taught a lesson. He would be sentenced to two months’ imprisonment with hard labour. Smoky Chimney. —W. Hunsley was charged with not consuming the smoke arising from the chimney of hia saw-mill in Colombo Street. Mr Piaber appeared to jprosecute, and Mr Stringer to defend. After hearing evidence and argument, the Bench dismissed the information, pointing out that the neighbours had a remedy by proceeding against the man for causing a public nuisance. Drunkenness. —W. Johnston for drunkenness in Tuam Street was fined 205., or 48 hours.
