Spedding wae the plaintiff and the New Zealand Shipping Company the defendant, plaintiff, claiming J£4o damages. Shortly stated the facta were that Messrs Collyns and Co., London, shipped by the Duke of Buckingham certain goods, and received the bille of lading, which purported on the lace of them that the freight had been paid in London. The bills were sold in the open market and purchased by Mr Spuddings’ agent. When the goods arrived here, delivery was refused by the Shipping Company until the freight was paid. Mr Spiddings. having sold the goods, paid the freight under protest both as to the sum payable and the rate. There was another CMe, in which pianos were shipped from Hamburg vi& London, the hill of lading being/stamped '‘freight prepaid.” The Company - : here gave up two' pianos, bub retained 'tbe other until the freight on the tfcree was paid.
