TTMAEU. Wednesday, Nov. 23. (Before His Honor Mr Justice Broad.) IN BANKRUPTCY. The following orders of discharge were granted:—J. J. Watterns (Mr Wood); 11. Newport, T. Brosnaliau (Mr Hay); J. M'Donald (Mr Lynch); Julius Siegert, Helier Fauvcl (Mr White). Costs were granted, at the same time out of the estates of Julius Siegert and H, Fauvel respectively. C. H. Reid appeared for examination and to answer certain charges formulated against him. Mr White (representing creditors and the Official Assignee) applied for an adjournment as lie had not anticipated the case coming on this session, believing that an appeal case would occupy all the time. Mr Tosswill (for bankrupt) strongly opposed tbe application, which, however, was granted. Rc Thomas Farrell and rc Hall and Meason. Motions and applications herein were adjourned. APPEAL. Benry Gayson v. Annie Waters. Mr White for appellant; Mr Perry for respondent. This was an appeal from an order of tho Resident Magistrate, adjudging appellant to pay certain moneys for maintenance of his alleged illegitimate child, in a recent affiliation case. His Honor pointed out that Mr Justice Williams had decided in Brosnan v. Stewart, that there was no appeal in bastardy cases upon the facts, and he felt bound by that decision, and therefore ho would order tho appeal to be struck out. His Honor added, that as under the Destitute Persons Act a Resident Magistrate can admit any evidence he likes, and can vary his order at any time, an appeal on the facts to a Court which would be bound by strict rules of evidence, was absurd. APPLICATION. An application, rc the Timaru AVoollen Factory Company, Limited, in liquidation, was postponed. The names' of Messrs Stubbs and Silverton were excepted from the list of contributories (they being sole objectors), on the application of Mr White. rnoiiATE. Probate was granted in rc Matthew Thompson, deceased, to his widow, and in rc Janet Pringle, deceased, to her father (Mr Hay); and in rc Frank tSchmith (Mr Wood).
