Michael Curran was fined £2 and costs for having refused to assist Police Constable Edmund Cotter- when he was called upon in the Queen's name to do so, when Cotter was taking a drunken maid to the lock-up. . Plaintiff claimed i>l2 2s. as a charge of 10 per cent on £121, being purchase money of some cattle which the defendant: had bought at auction, and not cleared in accordance with the conditions, iof sale. ,The defendant heard the conditions of sale read before he bought them. He was to furnish an approved endorsed bul for the amount before 4 o'clock on the day of sale. He did not do so, but came about 8 o'clock at night, stating he could not get a person to endorse the bill before, which plaintiff refused. . . Defendant said he bought the cattle, and he thought his tendering an endorsed bill was sufficiently complying with the conditions of sale. He could not get a person to endorsie it before 7or 8 o'clock. ' i Mr.Oakes said that-the 10 per cent charge was a penalty, and he knew of no law which empowered auctioneers to enforce penalties. M r v.-. . The Eesident Magistrate wiiihed Mr. Oakesto produce an authority which prevented auctioneers imposing any conditions they thought suitable.
