RESIDENT MAGISTRATE'S COURT LYTTELTON.
fv> c -n July bill. (tf efore the Resident Magistrate, and J. E Fitzgerald, Esq.) lhomas Critchley sued Augustus Alport, as Agent for the Conveyance Company, for the sum of 13s. 4d., wages due to him as seaman. Mr. Alport adimtted the wages to be due, but churned a set-off for damage done to a punt, his own private property, through the plaintiffs .of his vessel. It appeared that the plaintiff in working the vessel to Dampiers Bay, on the commencement of a Sou' Wester, fouled a punt of Mr. Alport's, lying at auchor, and did damage to the amount of £1.
The Magistrates decided that the pkimiffT~ liable for the damage done by foulfnj ?he « at anchor, but reserved the point as to whefi the Conveyance Company were, liable for* act of their servant, the plaintiff. be Mr. Alport paid the wages' claimprf j stated that he had wished thelase to£ ?&s* before the Court, in order to obtain the iS$ of the Magistrates on the two points Sl°n
