RESIDENT MAGISTRATE'S COURT.
(Before W. Jenkins, Esq., and F. B. Daniel,Esq., J.P.s.J Tuesday, March 2nd. Adams v. Callaghan. Two informations for assault. Mr Finn for complainant, Mr Turton for defence. J. G. Adams deposed that on the 13th February he was in the smithy at the Maryborough Battery (of which he was manager) and saw defendant putting a red-hot grubber in the finishingvice and remonstrated with him as he was destroying the vice. Defendant then used foul language, put up his fists, and challenged him to fight. He had threatened complainant several times previously. Cross-examined— Will swear it wasa red-hot grubber. Did not throw it over his head or near him. The forge is about fifty or sixty yards off the County road. The battery and property belong to a company. I am responsible to the directors. The road passes through the Company's machine site. A number of witnesses were examined, from whose evidence it appeared that strong language had been used on both sides, and that no assault had been committed. The Bench dismissed the informations, without costs.
