If the driver of a car responsible for an accident involving injury to the person he runs down dies, as the law stands at present the person run down cannot recover under the thirdparty risk. In other words, the claim dies with the defendant. This has been long* considered an injustice, and when the Automobile Association (Manawatu) was advised that the law draftsman was at present engaged in framing legislation to remedy the position, members expressed satisfaction.
