HEARING OF DIVORCE CASE.

NO EVIDENCE OF MISCONDUCT;

ON PART OF CO-RESPONDENT.

The hearing was continued in the Supreme Court this morning of the Bolton divorce suit in which Felix Stuart Hindmarsh Bolton, farmer, of Mangatainoka, petitioned for divorce from Eileen Margaret Bolton on the ground of alleged adultery- with John Edward Hewitt, farmer, Mangl&maire, from whom £SOOO is claimed.

His Honour, Mr Justice Ostler, said the application of counsel .for the corespondent to have the latter dismissed from the suit was giving him much anxious thought, but, added His Honour, tho admissions made by the wife are not evidence against the corespondent, but agjainst The petitioner to succ/eed in his case against the co-respondent must produce evidence which to a reasonable mind must be incompatible with innocence.

With regard to the allegations of adultery, His Honour had come to the conclusion that there was not sufficient evidence to prove these allegations. The evidence of the man Swan was not authoritative and there was no evidence that they were at the back of tho shed in the rcceration ground at Pahiatua for the purpose of committing adultery, and they were not there at night. Because there was no evidence of adultery with regard to happening at Hastings, Wellington, and Pahiatua, .His Honour said Ire must dismiss co-respondent from the suit.

The respondent's evidence is now being heard.
