JUDGMENT FOR DEFENDANT. Reserved judgment in favour of the defendant has been delivered in the Supreme Court action heard at Wellin.t- -■ >.>n recently in which an order for the taking of accounts and for an inquiry into the management of the late Captain Thomas Eekford’s estate was sought by Rachel Ellen Shugar, of Manurewa, Muriel May Lucas, of Taura nga, and Sarah Alicb Mutton, of Perth, Western Australia. married
daughters of the deceased, against Charles Alexander Eekford, one of his sons. The action was heard before Mr Justice Ostler and was adjourned sine die ponding a settlement, the terms of which, with the judgment for the defendant, are as follows: The defendant shall bo entitled to .be paid his costs of and in connection with the action, to include his witnesses’ expenses, to be taxed out of the estate of the late Captain Thomas Eekford. The defendant shall agree to pay to the plaintiffs the sum of £1250 in cash on their procuring and handing to the defendant a properly executed transfer 'or transfers signed by the plaintiffs I transferring all the shares owned by them respectively in T. Eekford mid Co., Ltd., to the defendant or his nominee. Of the sum of £1250, £955 shall be considered as purchase money for the shares and £295 shall be considered as a purely ex-gratia payment by the defendant to the- plaintiffs. On completion of these matters all claims by or on behalf of the plaintiffs arising out of or in respect to the estates of Thomas Eekford or Jane Eckford, or against the defendant personally. shall be deemed to have been abandoned and released by the plaintiffs.
