baring briefly opened the case called— Edward Lynch — I am a farmer and and dairyman living five or six miles above Crushington. Defendant is also a farmer and dairyman living five or six miles above Crus'hington, For six months past defendant's cattle have been tresptissing upon my agricultural lease. My hind is laid down in clover and grass. Gfive nolice to defendant's man of the trespass. Am prepared to say that the nolice required the " Cattle Trespass Act" was advertised for one month. Cross-examint'd— l never pave you a bill of particulars. Do not recollect you offering to assist me in. erecting a swing cate. Have complained to you free quently. Defendant said lie had a boy nvncling his, cattle constantly, awi they had to pass through plaintiff's land. My cows are fed on the river bed. Cross-examined — I have applied for o(acres0 (acres of land, [is Worship sail defendant had failed he proof of his case ; there was nothing beyond his bare assertion that he held an .agricultural lease or that his intention to claim' damages was duly advertised as irequired by the Act, ' Plaintiff would' therefore be nonsuited. ; OATO V.
