Ullyett filled the vacancy, and had scored 30 when an adjournment was made for lunch, Charlwood then being 23. The following are the scores at present :— Hill, c by Rhodes, b by Millington, 19 ; Jupp, c by Cargill bby Millington, 3 : Charlwood, not out, 23 ; Ullyett, not out, 30 ; byes 1, wides 1. About four o'clook rain setjin heavily and stamps were drawn, the game being 116 runs for six wickets. Chbistchubch, Feb. 3. , J.Twain, late Clerk of the Waimate Road Board, was committed for trial for embezzling £500 of the Boards funds. lhe Lyttelton Times this morning says :— " We learn tbat a writ has been issued by the Court of Queen's Bench, and was received in the colony by the Californian mail a few days ago, has been served by Messrs Brogden and Sons on the Hon. Mr Ormond for damages arising out of a breach of the immigration agreement of 1872. The writs name all the members of the Fox-Vogel Gov ernment of that year whose names appear on the record of the day as the Hon. W. Fox W. Gisborne, Julius Yogel, C.M.G., Sir D. M'Lean, C.M.G., J. D. Ormond, Mr Beeves, J. Hall, and H. T. Miller. The writ also for some reason includes the names of Messrs Sewell, Sir Francis Dillon Bell, and Mr Waterhouse, but for what reason it does not appear. We fear lhat Sir J. Yogel will be requesled to instruct the Solicitor-General to appear for all the defendants. Hokitika, Feb. 3. On the steamer Charles Edward leaving port a week ago a sailor named Chambers was missing. A. human body has been since washed ashore near Greymouth which is believed to be his. The banks this week exported upwards of six thousand ounces of gold, the produce of this district including Kumara. The ball snd banquet to the representative volunteers was held last night in the Town Hall and Volunteer Hall, which was connected by a temporary arcade. Two hundred persons were present, and the affair was a great success. The presentation of the prizes takes place to-day at noon.
