APPEALS HEARD
armed forces board SITTING HELD IN PAEROA REPORT STRONGLY CRITICISED A fitting of the No. 2 Armed Forces Appeal Board was held in the Courthouse, Paeroa, on Monday, the (.chairman, Mr S. L. Paterson, S.M., . presiding. Associated with him were ' .Messrs A. E. Manning, R. Coulter ;and the Crown representative, Mr D. Seymour. John Cave Hayes, a faumer of Netherton, applied for a re-hearing of an appeal which was dismissed at pt. hearing of the hoard on April 14, 1942. Appellant and his brother were milking 150 cows in two herds of 75 each with assistance of a boy from time to time. After hearing the appeal the'board granted the re-hearing, the chairman, Mr S. L. Patterson, S.M., stating that .at the previous hearing the. .board had been influenced in its decision by a report which had been put in by an officer of the Lands and Survey Department. The chairman stated that on the -evidence submitted all matters raised in the report had now been explained to the satisfaction of the board and there was nothing in it. He said it was a pity the inspector was not present because the board was entitled, when it called for a report, to have presented to it a.report on which it .could rely. Appellant - had been placed in a position which should not have arisen. The appeal was. adjourned sine die. - John James Corbett, a farmer, of Hikutaia, applied for re-instatement and re-hearing of an appeal which was withdrawn by appellant on February 9, 1942. Appellant was farming 120 acres and milking 55 cows. His two brothers were farming a nearby property of *l5O acres with approximately
'SO cows. One of the brothers had volunteered for the Air Force and had been turned down medically unfit owing to heart trouble. Appellant, realising one of them should serve had asked at a previous hearing for his appeal to be withdrawn subject to his being able to finish the season. He had relied upon the two brothers left to carry on the two farms. The brother who had been turned down had since been called up for overseas service and was in camp. In view of the changed circumstances and as two men were necessary to run the two farms he desired his appeal to be reinstated. The application was granted and the appeal adjourned sine die. G. A. L. Gibb, a farmer on his own account at Hikutaia, had his appeal adjourned sine die. He stated that he was helping his widowed mother (an invalid) to farm her property as well as own farm. H. P. Gillard, a farmer of Tirohia, appealed for his son, B. G. Gillard. The appeal was adjourned sine die on condition that reservist remain in the Home Guard. I. T. Biddle, a farmer of Turua, appealed for his son, A. K. Biddie. The .appeal was adjourned sine die on condition that reservist remains in the Home Guard.
