DAMAGES SOUGHT
CLERGYMAN’S ACTION. : ENGLISH DIVORCE ECHO. SYDNEY, June 20. Ah English clergyman is seeking to recover damages here from a Sydney University Medical School lecturer, arising out of divorce proceedings in England in 1935. A firm of Sydney solicitors acting on behalf of the clergyman, made an application before Mr Justice Bavin for leave to register in New South Wales, a verdict for damages of £SOO given in England. The verdict was obtained against H L. Brose, who had been named as corespondent in a suit for divorce brought by David Stephens against his wife. Dorothy Mary Stephens. Mr Stephens is the minister at the Boulevard Congregational Church, Nottingham, England, and Brose was described before the Court as a doctor or lecturer at the Medical School at the University of Sydney. According to testimony before Mr Justice Bavin Brose paid £75 of the damages while in England, leaving £425, which was to be paid direct to plaintiff. Between November, 193 G, and February last, in Sydney, Brose had promised to make restitution of the sum unpaid, but only £l2 10s had been tendered and a large amount remained. Registration of the judgment under Cue Administration of Justice Act, 1921, was necessary for enforcement against Brose. This provides that application may be made by summons or motion, for the registering in New South Wales of any judgment which has been obtained in a Superior Court of anj’ part of the British Dominions. Leave to register was granted.
