■ Failure by Bertram Egley, a solicitor, ol Wellington, to repay a- loin of £SOO a'ad interest, led to- proceedings ill the Supreme Court to-day, Alr s Lanr* Taylor, of Lower Hutt,. bringing a suit against .him. James Thomas Watson, a secretary, named as • Egleys’ guarantor, was joined as defendant.
The claim wais sefc out that ypl- 1 intifi, on Alay .7,, 1?30, lent Egley £SOO, interest At!‘l6 per cent., with exception of £lO on account o.f interest paid. On December 21, 1931, Egley had failed to make any payment. Demands had been made on Watson, but’ he had 'repudiated the deed, and denied liability..
In a. statement an . his defence, Watson denied that lie made any, agreement, whereby he guaranteed to plaintiff the repnynmut. .of ...the principle sum and interest claimed by her. He said, further, that if hits n.ame appeared in the deed - or the agreement, his execution thereof was obtained fraudulently, and on the representation tint he was witnessing o r attesting to some document, and that it was not disclosed to him ..that, he was entering into a, guarantee. ,or was rendering himself ltoble to plaintiff, or any other person. ho.' . When the case was called Air Barrett "sai.d: tlmt Egley h-id not: filed «• statement of his/ defence. Tt had been filed, by. the other defendant. His solicitors had intimated that, on further consideration, they did not pronose proceeding with it. His Honour, Air Justice Reed, entered judgment for plaintiff for £594 10s with costs, 'according to scale, and disbrugements.
