CONFECTIONER IN COURT

PALMERSTON N., May 6

A popular delicacy was discussed fully m the Palmerston North Magistrate's Court this morning, when John Duhovich appeared before Air J. L. .Stout, S.M., charged with selling icecream containing less than 10 per cent butter-fat.

Inspector Huggins, of the HealthDepartment, said, that ice-cream he purchased at the defendant’s shop contained only 7.5 per cent, of milk fat.

For the defence,'Mr Grant said that defendant was not selling ice-cream but ‘ice-cream ices.” Mr Grant said that there were raspberry ices and many other kinds of ices, and what the defendant was selling was “icecream” ices. “I suggest,” said Mr Grant, “that the word ‘ice-cream’ is only an adjective in the same way as ‘raspberry’ is in ‘raspberry-ices. ” Senior-Sergeant AYhitehouse said that outside the shop in gold letters fully six inches high was wiitteu “Ice-cream,” and inside was a menu with “ice-cream ices” written on it in small letters. Defendant’s explanation of this was that he had given up selling ice-cream before Christmas, and now sold only ice-cream ices. He had issued instructions to have the sign advertising ice-cream on the shop window removed, hut these instructions had not lieen carried out.

In imposing a fine of £2 upon the defendant, His Worship said that lie thought the words “ice-cream ice would lead the public to believe that they were getting ice-cream.
