The Court resumed at 2 p.m. ANOTHER DEFENDED CASE
Samuel Francis Orr (Mr Pilkington) v. Lambton and Co., and Applegarth, claim £4O 10s. Mr Pilkington said he proposed to withdraw the claim against Applegarth. Mr Applegarth appeared for the defence, and counter claimed •£lO 10s. The details of the claim wore disputed, arising out of wages and incidentals arising therefrom, the counter claim being for expenses incurred and loss sustained caused by the removal of part of a magneto from a lorry. After hearing considerable evidence by plaintiff, S. A. Dalziel, Jas. Shannon, and J. L. Applegarth, his Worship gave judgment for plaintiff for £3l 0s 2d with costs £6 6s.
On counter claim judgment was given for claimant for £5, with costs 7s, his Worship stating that plaintiff Orr deliberately tried to put defendant in a hole by the removal of the part of the magneto.
