Arising out of celebrations at Preston Road, Greymouth, on New Year’s morning, the warmth of the welcome extended to 1927 was not appreciated by Arthur McCarthy, who, with his wife and children, desired to get a few hours’ sleep. When, therefore, at two o’clock on New Year’s morning, fireworks began to sizzle and explode on the window sill of his shop, he lose in his wrath, and went on the trail of the disturbers of his peace. They were three juveniles, and Arthur, despite his bare feet, chased and caught one ot the youngsters. He then wont in search of the father of the other two hoys, William AlcPherson. to tell him what he thought of them. When AlcC arthy met .McPherson, then came the tug of war; after the war. came legal proceedings. .McCarthy laid an information against AlcPherson tor alleged assault, and the ease was heard by Mr Meldrum at the Greymouth Court yesterday, in the presence of a considerable audience. After hearing lengthy evidence the Magistrate said there was no doubt that defendant struck complainant; lie admitted striking him twice and the evidence as to the marks on McCarthy’s face showed that he had been hit pretty had. The question was whether defendant was justified in Ibis action. McPherson admitted that lie was not struck by McCarthy, and said that was due to his own smartness. If lie were so smart, surely he could have waited until McCarthy aimed a blow at him. I do not think lie has proved that lie struck -McCarthy in self defence,” said the S.M. " .McCarthy was no doubt excited, ns hoys had disturbed his child-, ren by letting off crackers. There was no occasion for AlcPherson to strike McCarthy with tlhe force that he did. J must hold that an assault was committed. There might (be an excuse tor the people being in a .somewhat excited state of mind, as they had been 'first-footing.’ hut AlcCarthy in a more peaceable state of mind, luul gone to bed. and was disturbed by the crackers. Defendant is convicted and find 61.”
